The following safety & courtesy rules are in place to ensure members and guests have a safe, enjoyable experience at The Golf Suite. Please use common sense and let safety and courtesy to other members guide your behavior.
General Rules
● Only one person in the hitting area (on turf) at a time.
● All shots must be directed forward, toward the screen.
● Before you swing any club, check your surroundings to ensure no person or obstacle is
within your swing range.
● Be aware of your backswing and follow-through at all times.
● Practice swings should be confined to the hitting mat.
● Be aware of others--stay out of range of others' swings.
● Be alert to the possibility of flying tees and golf balls that may ricochet.
● Immediately report any accidents.
Tee Time Required Maximum access to the simulator depends upon accurate scheduling by
members. Unscheduled access is not permitted. Should you choose to breach this rule, your
membership will be subject to immediate termination without refund. Each one-hour tee time
includes 50 minutes of practice time and 10 minutes built in to prepare for, wipe down after, and
transition to the next member. Please be prompt in both your arrival and departure as a courtesy to
other members.
Clean Golf Balls Only Only use clean balls provided--dirty and sharpie-marked balls
damage the screen. Please refrain from adding any to your personal collection and leave balls to be
enjoyed by all members.
Membership Terms Signing up for a monthly membership denotes a three month minimum commitment.
Further cancellation needs to be requested by phone/email 7-days in advance of the next payment.
Clean Club Faces A club cleaner and towels are provided for this purpose. Dirty clubs will damage
the screen.
No Metal Spikes are allowed but regular golf shoes are permitted.
No Food or Drink on the Turf Please keep food & drinks off the turf and at the provided tables.
Make sure that all trash is thrown away and the area is clean prior to your departure.
No Alcohol In accordance with Texas State Liquor Laws, no alcohol to be consumed inside the
club.
24/7 Video Surveillance Be advised that the premises are under 24/7 video surveillance. By using
our facilities, you give The Golf Suite, LLC express permission to record your likeness, including
utilization of Google's familiar face technology. Tampering with the security system or damaging
equipment will result in financial liability and membership termination.
Individual Membership All memberships are sold on an individual basis. You may bring the number
of guests permitted by your membership category, but you are responsible for and must accompany
them at all times. Members may not, under any circumstances, share their login information to allow
entry to the studio by another person. Violation of this rule will result in immediate forfeiture and
termination of any remaining membership without recompense.
Prohibited Use of Other Areas in Facility The Golf Suite simulator room is part of a larger sports
related facility that contains areas for weight training and other exercise space and equipment. A
Golf Suite membership does not entitle the member or the member’s guest to have access to, or
use, such other weight training and exercise space. Use of such other equipment and exercise
space by Golf Suite members is strictly prohibited.
Rule Updates/Modifications/Failure to Comply These rules may be updated and modified at any
time by The Golf Suite, LLC and members agree to abide by such as a continuing condition of their
membership. Members and guest are financially responsible for any damages caused by failure to
follow these Safety & Courtesy Rules. Failure to abide by any of the Safety & Courtesy Rules may,
at the discretion of The Golf Suite, LLC, result in cancellation of the remainder of your paid simulator time without compensation.
In consideration of The Golf Suite, LLC "Golf Suite" allowing me to enter and use its facilities I agree
to the following:
1. Assumption of Risk I know and understand the scope, nature, and extent of the risks involved in
participating in indoor golf and that these risks include but are not limited to: equipment malfunction;
defective and/or negligent design and/or manufacture of equipment; carelessness and/or negligent
instruction and/or supervision; negligent rescue operations; and being hit by a golf club, golf ball, or
golf tee. I agree that Golf Suite is not responsible for these and other unexpected occurrences and
that I will play at my own risk and voluntarily, freely, and expressly choose to incur all risks
associated with using Golf Suite’s facilities, understanding that those risks may include personal
injury, damage to property, and/or death.
2. Rules & Security Cameras I agree to follow the courtesy and safety rules given to me or posted
at the facility or on Golf Suite’s website, which are intended to protect me, my guests/invitees, and
other patrons. I acknowledge that the facilities are under video surveillance and that my activities
therein may be recorded. I agree that my membership and access to the facilities are contingent
upon following the rules and may be terminated at any time for a violation thereof without financial
compensation.
3. Damages I agree that I am responsible for any damages to the facilities caused by myself, my
minor children, and my guests/invitees (collectively, the “Releasing Parties”), including but not limited
to cameras, computers, speakers, projector, lighting, televisions, training equipment, the
“FORESIGHTS” program, furnishings, and the physical facilities themselves.
4. Exemption and Release From Liability I exempt and release the following persons,
corporations, and organizations: Golf Suite, the facility owner and each of their managers, members,
officers, agents, employees, representatives, and consultants (collectively the "Releasees"), from
any and all liability, claims, demands or actions or causes of action whatsoever arising out of any
damage, loss or injury to me or my property, or my death, while upon the premises, WHETHER
RESULTING FROM THE NEGLIGENCE AND/OR OTHER FAULT, EITHER ACTIVE OR PASSIVE,
of any of the Releasees, or from any other cause.
5. Covenant Not to Sue I agree never to institute any suit or action at law or otherwise against any
of the Releasees, or to initiate or assist in the prosecution of any claim for damages or cause of
action which I may have by reason of injury to my person or property, or my death, arising from the
activities covered by this Agreement, WHETHER RESULTING FROM THE NEGLIGENCE AND/OR
OTHER FAULT, EITHER ACTIVE OR PASSIVE, of any of the Releasees, or from any other cause. I
further agree that my heirs, executors, administrators, personal representatives, and/or anyone else
claiming on my behalf, shall not institute any suit or action at law or otherwise against any of the
Releasees, nor shall they initiate or assist the prosecution of any claim for damages or cause of
action which I, my heirs, executors, administrators, personal representatives, and/or anyone else
claiming on my behalf may have by reason of injury to my person or property, or my death, arising
from activities covered by this Agreement, WHETHER RESULTING FROM THE NEGLIGENCE
AND/OR OTHER FAULT, EITHER ACTIVE OR PASSIVE, of any of Releasees, or from any other
cause. I hereby so instruct my heirs, executors, administrators, personal representatives, and/or
anyone else claiming on my behalf. Should any such suit or action at law or otherwise be instituted
against any of the Releasees, I agree that such Releasees shall be entitled to recover attorneys'
fees and costs incurred in defense of such suit or action, including any appeals therefrom.
6. Indemnity Against Third Party Claims I agree to indemnify, save and hold harmless the
Releasees from any and all losses, claims, actions, or proceedings of every kind and character,
including attorney's fees and expenses, which may be presented or initiated by any of the Releasing
Parties and any other persons or organizations and which arise directly or indirectly from my
participation in the activities covered by this Agreement, WHETHER RESULTING FROM THE
NEGLIGENCE AND/OR OTHER FAULT, EITHER ACTIVE OR PASSIVE, of any of the Releasees
or from any other cause.
7. Complete Defense I agree that this Agreement may be pleaded as a complete defense to any
action or proceeding that may be brought or instituted by me, any of the Releasing Parties or by our
respective heirs or legal representatives.
8. Representations and Warranties I represent and warrant that I am physically fit, have
sufficiently prepared or trained for participation in this activity, and have not been advised to not
participate by a qualified medical professional. I certify that there are no health-related reasons or
problems that preclude my participation in any and all activities at the premises. I represent and
warrant that I have the authority to enter into this Agreement on behalf of all Releasing Parties. I
further represent and warrant (and indemnify Releasees from any claim to the contrary) that I have
legal and physical custody of all minor children or wards who are Releasing Parties by virtue of my
signing this Agreement and have legal authority to sign this Agreement on their behalf.
9. Other Areas in Facility I understand and acknowledge that the Golf Suite simulator room is part
of a larger sport facility which contains weight training and other equipment. As provided in the Golf
Suite Safety & Curtesy Rules, my membership with Golf Suite strictly prohibits the use by me or any
of my guests of any such weight training and other equipment. In the event that I or any of my
guests use or try to use any of such other areas in the sport facility, including use of such weight
training or other equipment, I will be fully responsible for any and all damages, injury, liability, causes
of action and other claims resulting from the use thereof by me or my guests, and any such use will
be subject to the terms and conditions of this Waiver.
10. Applicable Law I agree that the law of the State of Texas shall apply to issues involving the
construction, interpretation, and validity of this Agreement and that Texas law shall govern any
dispute between the parties arising from the activities contemplated by this Agreement.
11. Waiver of Jury Trial and Venue Should this Agreement be violated, and a suit be brought
against any of the Releasees, each party waives their right to a jury trial, and Dallas, Texas shall be
the venue for any such suit.
12. Interpretation & Severability I agree that this Agreement is intended to be as broad and
inclusive as is permitted by the laws of the State of Texas and that should one or more provisions in
this Agreement be judicially determined to be unenforceable, the remaining provisions shall continue
to be binding and enforceable against each party.
13. Acknowledgement I hereby acknowledge that I have read all of the provisions above and fully
understand the terms and conditions expressed herein and agree to be bound by such terms and
conditions.
14. Continuation of Obligations I agree that the terms and conditions of this Agreement shall
continue in full force and effect now and in the future, at all times that I use the facilities.
I AM FULLY AWARE OF THE RISKS ASSOCIATED WITH GOLF AND INDOOR GOLF,
PARTICULARLY AS THEY EXIST IN THE CONFINES OF AN ENCLOSED INDOOR AREA, AS
BOTH A SPECTATOR AND A PARTICIPANT, INCLUDING THE POSSIBLE RECKLESS
CONDUCT OF OTHER PARTICIPANTS AND SPECTATORS. I AGREE TO ACCEPT ANY AND
ALL RISKS ASSOCIATED THEREWITH. BY MY PRESENCE AS A PARTICIPANT OR
SPECTATOR AT THE PREMISES, AND/OR BY MY ACCEPTANCE AND USE OF AN ACCESS
CODE TO THE PREMISES, I AGREE AND CONSENT TO ALL OF THE TERMS OF THIS
